General Terms and Conditions

1. Provider and scope

These General Terms and Conditions apply to orders placed in the SIDEBüRNS Merch Booth online shop, operated by Ralf Weymann, SIDEBüRNS, Otto-Schott-Straße 1, 99427 Weimar, Germany, email shop@sideburnsrock.com, telephone +49 3643 211 73 93 (referred to below as “we”, “us” or the “seller”). They cover purchases of merchandise, physical music releases and digital music downloads. Mandatory statutory consumer rights remain unaffected.

2. Products and product information

The essential product characteristics, variants, formats, prices and availability are stated on the respective product pages. The appearance of product images on a screen may differ from the actual goods. The respective product description provides the binding information about the product characteristics. Changes to our range do not apply retroactively to contracts already concluded.

3. Orders and conclusion of the contract

The presentation of products in the shop does not constitute a legally binding offer to enter into a contract. By submitting an order, the customer makes a binding offer to purchase the selected products. A contract is concluded when we accept the order, for example by sending an express confirmation of acceptance, dispatching the goods or making the digital content available. Whether an automatic order confirmation already constitutes acceptance depends on its content.

4. Prices and payment

The final prices displayed during the ordering process, together with any taxes, shipping costs and other applicable charges, are shown before the order is submitted with binding effect. Available payment methods are displayed at checkout. Prices already agreed are not subsequently changed unilaterally. The customer must provide accurate information required for payment and delivery.

5. Shipping and delivery

Delivery countries, shipping options, shipping costs and estimated delivery times are stated in the shop or before the order is submitted. Estimated delivery times are non-binding unless a binding delivery date has expressly been agreed. For consumer purchases, the risk of accidental loss or deterioration of the goods generally passes only when the goods are handed over to the consumer or a person authorised by the consumer to receive them; statutory exceptions remain unaffected. Handing the goods to a shipping service offered by the shop generally does not suffice for this purpose.

6. Digital music downloads

Digital content is supplied in the format and by the delivery method described on the product page. For paid digital content, the statutory right of withdrawal can expire early only if the statutory requirements are met, including express consent, acknowledgement of the consequences and the provision of a contract confirmation on a durable medium. Expiry is not assumed solely because an order has been submitted. Unless other terms of use are expressly stated, downloads are supplied for personal, non-commercial use. Copyright or redistribution rights are not transferred.

7. Withdrawal, voluntary returns and refunds

The statutory withdrawal information, return shipping costs and the additional voluntary 30-day return offer are described in the separate “Withdrawal information and return conditions” policy. Statutory warranty rights and rights of withdrawal are not restricted by these provisions. You may contact us to exercise your right of withdrawal or use an electronic withdrawal function provided in the shop.

8. Statutory rights in the event of defects

Consumers have the statutory rights applicable to defective goods and digital content. Any additional manufacturer’s warranties or voluntary guarantees, where available, are described separately and do not affect statutory rights. We bear the necessary costs of supplementary performance to the extent required by law.

9. Intellectual property

Texts, graphics, illustrations, photographs, audio recordings, artwork and trademarks on this website may be protected by copyright, trademark or other intellectual property rights. Buying a physical music release or download does not transfer rights to commercially reproduce, publicly distribute or share copyright-protected content. Private uses permitted by law remain unaffected.

10. Website and third-party services

The online shop uses services provided by Shopify and, where applicable, other service providers. External links lead to third-party services whose terms may apply. Our statutory obligations as the seller remain unaffected.

11. Data protection

The processing of personal data is explained in the separate Privacy Policy. It remains independent of these terms of purchase; statutory data protection rights remain unaffected.

12. Permitted use of the website

The website must not be used unlawfully or in a way that compromises its security. Third-party rights must be respected. Uses permitted by law are not restricted by this provision.

13. Liability

Our liability is governed by statutory provisions. In particular, liability that cannot legally be excluded, loss arising from injury to life, body or health, and statutory consumer rights are not excluded. No blanket exclusions of liability towards consumers are agreed.

14. Applicable law

German law applies insofar as it does not conflict with mandatory consumer protection provisions of the country in which a consumer has their habitual residence. The statutory rules on jurisdiction remain unaffected. No exclusive place of jurisdiction to the detriment of consumers is agreed.

15. Changes to these terms

The version of these General Terms and Conditions applicable when the contract is concluded applies to an order. Subsequent changes do not apply retroactively to contracts already concluded without an appropriate legal basis or a valid agreement.
